1. Introduction

These Terms and Conditions govern the use of the Eman Way Agent Portal operated by Eman Way Travel & Tours HQ, a MOTAC-licensed travel agency (License No. KPK/LN:12228) registered in Malaysia. By accessing or using the Agent Portal, you agree to be bound by these terms.

2. Agent Registration

To use the Agent Portal, you must complete the registration process and provide accurate business information including your agency name, registration number, and valid business license. All registrations are subject to review and approval by Eman Way administrators.

You are responsible for maintaining the confidentiality of your account credentials. Any activity under your account is your responsibility.

3. Agent Obligations

As a registered agent, you agree to:

  • Provide accurate and truthful information to customers regarding travel packages.
  • Not misrepresent Eman Way's services, pricing, or availability.
  • Comply with all applicable Malaysian laws and regulations, including those set by the Ministry of Tourism, Arts and Culture (MOTAC).
  • Handle customer data with care and in compliance with Malaysia's Personal Data Protection Act 2010 (PDPA).
  • Not engage in fraudulent, deceptive, or unethical business practices.

4. Commissions & Payments

Agent commission rates are set by Eman Way and may vary by package type. Commissions are calculated on confirmed and completed bookings only. Eman Way reserves the right to adjust commission structures with prior notice. Payments are processed according to the schedule communicated during onboarding.

5. Booking & Cancellation

All bookings made through the Agent Portal are subject to Eman Way's booking and cancellation policies. Agents must inform customers of all relevant terms before confirming a booking. Cancellation and refund requests are handled in accordance with the specific package terms and applicable laws.

6. Intellectual Property

All content, branding, logos, and materials on the Agent Portal are the property of Eman Way Travel & Tours HQ. Agents may use Eman Way branding materials solely for the purpose of promoting Eman Way packages and must not alter or misuse them.

7. Account Suspension & Termination

Eman Way reserves the right to suspend or terminate agent accounts that violate these terms, engage in fraudulent activity, or fail to meet performance standards. Upon termination, agents must cease all use of Eman Way branding and materials.

8. Limitation of Liability

Eman Way provides the Agent Portal on an "as is" basis and makes no warranties regarding uninterrupted service. Eman Way shall not be liable for indirect, incidental, or consequential damages arising from the use of the portal.

9. Changes to Terms

Eman Way may update these terms at any time. Continued use of the Agent Portal after changes constitutes acceptance of the revised terms. Agents will be notified of significant changes via email or portal notification.
